Terms & Conditions
These Terms & Conditions apply to purchases made through Merchant’s Nest. They are intended to be read with our Returns & Cancellations, Privacy, Cookie and Company Information pages. Mandatory consumer rights under Irish and applicable EU law are not excluded or reduced by these terms.
1. About Merchant’s Nest
The website is operated by Merchant’s Nest Decor & Design Limited, an Irish private company limited by shares, company registration number 765269, with registered office at 20 Sorrel Green, Sorrel Wood, Blessington, Co. Wicklow, W91 YC8W, Ireland. Email: info@merchants-nest.com. Phone: +353 87 452 1090.
2. Scope of these terms
These terms apply primarily to consumer purchases through our online store. Trade customers, interior designers, architects, hospitality clients and commercial customers may be subject to separate written quotations, project terms, account terms or agreements. Where separate written terms are agreed for a project, those terms take priority to the extent of any inconsistency.
3. Product information
We take reasonable care to ensure that product descriptions, dimensions, prices, images and specifications are accurate. Screens, lighting conditions, printing processes, materials, handmade production and batch variation can cause reasonable differences in colour, texture or appearance. Such normal variation is not intended to limit your statutory rights where goods are faulty, misdescribed or do not conform to the contract.
Wallpaper scale, crop, panel size, repeat, substrate, finish and installation requirements can materially affect the finished result. Where samples are available, we strongly recommend ordering and assessing a sample in the intended room before placing a full order.
4. Orders and contract formation
Placing an order is an offer to purchase. A contract is formed when we accept your order. Automated acknowledgements confirm receipt but do not necessarily amount to acceptance unless they expressly state otherwise.
Before acceptance, we may decline or cancel an order where a product is unavailable, a price or description contains an obvious error, payment cannot be authorised, delivery is not available to the address supplied, or we reasonably suspect fraud or misuse. If payment has already been taken for an order we cannot accept, the relevant amount will be refunded.
5. Prices, VAT, delivery and payment
Prices and any applicable VAT or other taxes will be displayed as required by law. Delivery charges and other mandatory charges will be shown before you place your order where applicable. For destinations outside the territory in which taxes or duties are collected by us, local import duties, taxes or customs charges may be payable by the recipient where permitted by law.
Payment must be made using an accepted payment method and must be successfully authorised. We may use third-party payment providers to process payments securely.
6. Samples
Wallpaper samples are intended to help assess colour, print quality, material and artwork detail. With large-scale murals or artwork, a sample may show only part of the overall image or may not reproduce the full finished scale. A sample is therefore not always a complete representation of the final wall composition.
7. Made-to-measure, customised and personalised goods
Many wallpapers and other products may be manufactured to measurements, dimensions, colourways, crops, layouts or other specifications supplied or approved by you. You are responsible for checking measurements and any artwork or specification approval you provide. We remain responsible for producing the goods in accordance with the agreed specification.
Where goods fall within the legal exception for goods made to a consumer’s specifications or clearly personalised, the statutory change-of-mind cancellation right may not apply once the contract falls within that exception. This does not affect rights where goods are faulty, damaged, misdescribed or otherwise do not conform to the contract.
8. Measurements and site conditions
Unless Merchant’s Nest has expressly agreed in writing to carry out measurements, you are responsible for providing accurate dimensions and relevant site information. Allowances for trimming, irregular walls, coving, skirting, sloped ceilings, sockets, windows, doors and other architectural features should be considered when measuring.
We are not responsible for losses caused solely by inaccurate measurements or incomplete site information supplied by the customer or a third party, but nothing in this clause limits liability for our own error or for inaccurate information supplied by us.
9. Installation
Unless installation is expressly included in a written quotation, installation is not part of the sale. Specialist or made-to-measure wallcoverings should be installed by a suitably competent installer in accordance with any relevant manufacturer or supplier instructions.
Before installation, goods should be inspected for obvious damage, printing issues, colour inconsistency or specification errors. Installing goods that visibly appear incorrect may affect the practical remedy available, but does not remove any statutory rights that cannot lawfully be excluded.
10. Delivery
Estimated production and delivery times are estimates unless a specific delivery date has been expressly agreed. Made-to-order production time is additional to carrier transit time unless stated otherwise.
For consumer sales, risk normally remains with Merchant’s Nest until the goods are physically received by you or by a person you nominate, except where applicable law provides otherwise.
11. Consumer cancellation rights
For most standard goods bought online, consumers have a statutory 14-day cooling-off period beginning when the goods are received. You must notify us within that period if you wish to cancel, and goods must then be returned within the applicable legal timeframe. Legal exceptions apply, including for certain goods made to specification or clearly personalised.
Where the statutory right to cancel applies, refunds will be handled in accordance with applicable law, including any applicable standard delivery charge. You may be responsible for return costs where the law permits and where you have been informed of that responsibility.
See our Returns & Cancellations page for further details.
12. Faulty or non-conforming goods
Your statutory rights under the Consumer Rights Act 2022 and other applicable consumer law remain fully protected. Depending on the circumstances, remedies may include repair, replacement, price reduction, termination of the contract or refund. Nothing in these terms replaces or narrows those rights.
13. Services and Studio work
Interior direction, styling, sourcing, consultations or other Studio services may be subject to a separate proposal, scope, fee structure or project agreement. Where a consumer purchases a service online, applicable statutory cancellation rights may apply unless a lawful exception applies or performance begins with the consumer’s express request and the legal conditions for charging for work performed or loss of cancellation rights are satisfied.
14. Trade and business customers
Where you purchase wholly or mainly for business purposes, consumer-law protections may not apply. Unless otherwise agreed in writing, quotations are based on the information supplied by the trade customer and may be revised if quantities, specifications, delivery requirements or project scope change.
To the extent permitted by law for business-to-business transactions, Merchant’s Nest will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of opportunity or loss arising from delay outside our reasonable control. Any liability limitation will not apply where it would be unlawful to exclude or limit liability.
15. Intellectual property
All artwork, wallpaper designs, images, text, branding, graphics and other intellectual property displayed on the site belong to Merchant’s Nest, the relevant artist, supplier or licensor. Purchase of a product does not transfer copyright or other intellectual-property rights. No website content or product artwork may be copied, reproduced, adapted or used commercially without permission from the relevant rights holder.
16. Website use
You must not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious code, scrape content at scale for commercial reuse, or use our content in a way that infringes intellectual-property rights or applicable law.
17. Promotions and discounts
Promotions may be subject to separate conditions, availability, validity periods, exclusions or minimum spend requirements. Unless stated otherwise, discounts cannot be combined. Statutory rights are unaffected by promotional pricing.
18. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of mandatory statutory rights or any other liability that cannot lawfully be excluded or limited.
For consumer purchases, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for losses that are not reasonably foreseeable or for business losses arising from a consumer transaction.
19. Events outside our reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, customs delays, industrial action, severe weather, supply interruption or other comparable events. We will take reasonable steps to reduce disruption and keep you informed where a delay materially affects your order. Mandatory consumer rights remain unaffected.
20. Privacy and cookies
Personal data is handled in accordance with our Privacy Policy. Cookies and similar technologies are explained in our Cookie Policy.
21. Changes to these terms
We may update these terms from time to time. The terms that apply to an order are those in force when the relevant contract is formed, unless a change is required by law or is expressly agreed with you.
22. Governing law and disputes
These terms are governed by Irish law. If you are a consumer resident in another country, this does not deprive you of mandatory protections that apply under the law of your country of residence. Courts with jurisdiction under applicable law may hear disputes.
23. Contact
